LeaseLark Terms of Service
Effective Date: 09-23-2025
1. Eligibility
You must be at least 18 years old and legally able to enter into binding contracts. By using LeaseLark, you represent and warrant that all information you provide is true, accurate, and complete.
2. Use of Services
LeaseLark provides tools to search rental listings, submit rental applications, communicate with property managers, and process rent payments.
You agree not to misuse the Services, including by:
- Submitting false or misleading information (including false applications, documents, or payment details).
- Harassing, abusing, or discriminating against tenants, applicants, or other users.
- Engaging in fraudulent activity (including chargebacks, stolen credit cards, or unauthorized ACH transfers).
- Using the Services for unlawful purposes, such as money laundering or fraudulent schemes.
- Attempting to gain unauthorized access, disrupt, or reverse-engineer the platform.
LeaseLark may suspend or terminate your account and pursue legal remedies if you violate these Terms.
3. Accounts and Security
You must create an account to apply for rentals or submit payments. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify LeaseLark immediately if you suspect unauthorized access.
4. Applications and Fees
Submitting a rental application may require payment of an application fee, background check fee, or other screening charges. Fees are disclosed prior to submission and are non-refundable once processing begins.
You authorize LeaseLark and its partners to conduct background, credit, employment verification, and rental history checks as part of the application process.
5. Rent Payments & Disbursement
Tenants may submit rent payments through LeaseLark via ACH, credit/debit card, or other approved methods. Payments are subject to clearing and settlement timelines. LeaseLark processes disbursements to property managers in cycles (1st–5th, 6th–15th, 16th–31st of each month). Payments must clear before funds are released to landlords/property managers.
LeaseLark is not a bank or financial institution and does not hold funds on behalf of tenants or landlords except as necessary to process transactions.
6. Add-Ons and Transactional Fees
Certain features may incur additional fees, including but not limited to:
- Utility payment handling
- Security deposits
- Amenity booking or rental fees
All such fees will be disclosed before use or purchase.
6A. Refunds and Chargebacks
Refund policies for tenant payments (including rent, deposits, and fees) are determined solely by the property manager or owner. LeaseLark does not issue refunds on behalf of property managers or owners. In the event of a chargeback or returned transaction, you are responsible for any associated fees.
LeaseLark reserves the right to suspend your account or limit Services if chargebacks, disputes, or failed payments occur.
7. Listings and Content
Rental listings and property details are provided by property managers, landlords, or third parties. LeaseLark does not guarantee the accuracy, completeness, or availability of any listing. You are responsible for verifying listing details before entering into a lease agreement. LeaseLark does not own or manage rental properties and is not a party to lease agreements between tenants and landlords.
8. Communications (Including SMS)
By using the Services, you consent to receive electronic communications (emails, SMS, in-app notifications) regarding your account, applications, payments, and updates.
Program Description
LeaseLark offers SMS updates related to property management services, including account notifications, payment reminders, maintenance updates, tenant/landlord communications, and promotional alerts (if applicable). Message and data rates may apply. Message frequency varies by account activity. Consent to SMS is not a condition of rental or lease approval.
Opt-Out Instructions
You can cancel SMS messages at any time by texting STOP to 302-947-8573. After you send STOP, you will receive one final confirmation message stating you have been unsubscribed. After that, you will no longer receive SMS messages from LeaseLark. To re-subscribe, sign up again through your account or text opt-in process.

Privacy & Data Use
LeaseLark does not sell or rent mobile numbers or SMS consent data. Mobile numbers and related information may only be shared with trusted service providers to verify tenant information, process payments, or support functionality.
9. Privacy & Data Use
LeaseLark collects and uses personal data in accordance with our Privacy Policy. Data may be shared with third-party partners for screening, verification, and payment processing, but will not be sold for marketing purposes.
10. Compliance with Law
You agree to comply with all applicable federal, state, and local housing, rental, and fair housing laws. Discriminatory use of LeaseLark’s Services is strictly prohibited.
11. Intellectual Property
All content on LeaseLark (logos, trademarks, design, software) is owned by or licensed to LeaseLark. You may use the Services only for personal, non-commercial rental purposes.
12. Disclaimers
LeaseLark provides the Services “as is” without warranties of any kind. We do not guarantee rental outcomes, lease approval, payment success, or uninterrupted service. LeaseLark is not responsible for the actions of landlords, property managers, or third parties.
13. Limitation of Liability
To the maximum extent permitted by law, LeaseLark shall not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the Services. Our total liability to you will not exceed the amount paid by you for the Services in the 12 months prior to the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless LeaseLark, its affiliates, officers, directors, employees, agents, successors, and assigns from and against any and all claims, actions, demands, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services or violation of these Terms.
15. Termination
You may terminate your account at any time by contacting support at support@leaselark.com. LeaseLark may suspend or terminate access at its discretion if you violate these Terms.
16. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved under the Federal Arbitration Act (FAA) through binding arbitration in Delaware, except that disputes under $10,000 may be brought in small claims court. You waive the right to participate in class actions, consolidated claims, or jury trials.
17. Changes to Terms
LeaseLark may update these Terms from time to time. Changes will be posted on this page with the “Effective Date.” Continued use of the Services after such updates constitutes your acceptance of the revised Terms.
18. Force Majeure
LeaseLark will not be liable for delays or failures caused by events beyond our reasonable control, including natural disasters, labor disputes, internet outages, cyberattacks, or government restrictions.
19. Taxes, Fees, and Ancillary Charges
- Taxes: Property managers and landlords are solely responsible for all sales, use, VAT, GST, excise, or similar taxes imposed by governmental authorities in connection with the Services, other than taxes on LeaseLark’s income. Where LeaseLark has a legal obligation to collect such taxes, they will be invoiced in addition to subscription or licensing fees.
- Ancillary and Transactional Fees: Additional charges beyond subscription or licensing fees, including application fees, background check fees, late fees, convenience fees, or other pass-through amounts. Such charges may be retained by LeaseLark or remitted to third-party vendors or processors, as applicable.
- Role of LeaseLark: LeaseLark is not a landlord, property owner, bank, or financial institution. LeaseLark makes no representation or warranty as to the legality, enforceability, or tenant-law compliance of any fee imposed by property managers. LeaseLark’s role is limited to facilitating the payment process.
- Indemnification: Property managers agree to indemnify and hold LeaseLark harmless from any claims, liabilities, damages, costs, or expenses (including attorneys’ fees) arising out of: (i) failure to pay or collect applicable taxes; (ii) imposition of fees on tenants; or (iii) disputes concerning the legality or enforceability of such fees under landlord–tenant law.
